1) General Product and Care Information

Different visual display devices, including computer monitors, tablets, smartphones and other screens, may display colours, contrast, brightness and saturation differently. The appearance of artworks, photographs, prints, editions, designs, products and other content shown on froosty.ai may therefore differ from the appearance of the corresponding physical product or printed artwork. The product characteristics expressly stated in the respective product description remain decisive.

The appearance of physical artworks, Fine Art Prints, editions and other printed products may be affected over time by environmental influences. Depending on factors such as exposure to light or direct sunlight, heat, humidity, air quality and temperature fluctuations, materials and colours may change to varying degrees.

Unless expressly stated otherwise in the respective product description, paper-based artworks, Fine Art Prints, editions and other printed products intended for display are designed for ordinary indoor use. They should not be exposed to outdoor conditions, unusually high humidity, excessive heat, prolonged direct sunlight or significant temperature fluctuations unless the respective product is expressly identified as suitable for such conditions.

To reduce the risk of fingerprints, scratches, abrasion or other damage, artworks and Fine Art Prints should be handled carefully. Where appropriate, clean protective gloves or comparable suitable handling measures may be used, particularly when handling unframed Fine Art papers and sensitive printed surfaces.

Any product-specific care, handling, framing, installation or storage instructions stated for or supplied with the respective product should also be observed.

These general care notes do not constitute a promise of a particular service life, colour permanence, resistance or unchanged appearance beyond the product characteristics expressly agreed for the respective product. They do not limit or exclude any mandatory statutory rights of customers, including statutory rights in the event of defects.

2) Ownership and Intellectual Property Rights

By purchasing a physical artwork, edition, print, design, product or other item through froosty.ai, the purchaser acquires ownership of the purchased physical item subject to full payment of the purchase price and the retention of title agreed in the applicable Terms of Service & Conditions.

The purchase of a physical item does not by itself transfer copyright, reproduction rights, commercial exploitation rights, publication rights, licensing rights, trademark rights or other intellectual property or usage rights in the underlying artwork, motif, photograph, design, text or other protected content. Rights of use are transferred only where and to the extent expressly agreed or otherwise provided by applicable law.

Unless expressly permitted by applicable law or expressly authorised by the respective rights holder, protected FROOSTY® content may not be reproduced, commercially exploited, licensed, published, distributed in the form of reproductions, made publicly available online, used for advertising, merchandising, print-on-demand, NFTs or blockchain-based exploitation, or incorporated into other products, publications or commercial content.

Statutory limitations, exceptions and other legally permitted uses remain unaffected.

The contractual terms applicable to an order are those made available to the customer and validly incorporated into the respective contract during the ordering process. The current Terms of Service & Conditions can be accessed online.

RESALE & COMMERCIAL USE. Any lawful resale or other further distribution of an acquired physical artwork, edition, print or product is governed by the applicable statutory provisions. Where the statutory principle of exhaustion applies, the lawful resale of the physical item is not prohibited.

The resale of a physical item does not transfer any additional copyright, reproduction, licensing, publication, trademark or other intellectual property or usage rights in the underlying artwork, motif, photograph, design or other protected content.

Commercial use of FROOSTY® artwork files, reproductions, product photographs, texts, Certificates of Authenticity, logos, trademarks, branding or other protected presentation materials beyond uses permitted by applicable law requires prior authorisation from the respective rights holder.

The FROOSTY® name, trademark and other protected signs may be used only within the limits permitted by applicable trademark and other applicable law. In particular, any use must not create a misleading impression of an official dealership, gallery representation, licence, cooperation, sponsorship or other commercial relationship with FROOSTY® where no such relationship exists.
