EDITIONS & RIGHTS

1) EDITIONS & AUTHENTICITY

FROOSTY® offers different edition structures depending on the respective art category and product. The three principal art categories are AI POSTERS, AI ARTWORKS and AI COLLECTOR’S EDITIONS. The applicable edition type, edition size and product-specific characteristics are stated on the respective product page and form part of the agreed product characteristics.

AI POSTERS. AI POSTERS may be offered as Limited Editions or Open Editions. Limited AI POSTERS are individually numbered. Open-edition AI POSTERS are not individually numbered. AI POSTERS do not include a Certificate of Authenticity or a separate artist signature.

AI ARTWORKS. AI ARTWORKS are offered exclusively as Limited Fine Art Editions. Each AI ARTWORK includes a Certificate of Authenticity, is individually numbered and is hand-signed by the artist FROOSTY®.

AI COLLECTOR’S EDITIONS. AI COLLECTOR’S EDITIONS are offered as unique works or in exceptionally small Limited Editions. Each AI COLLECTOR’S EDITION includes a Certificate of Authenticity, is individually numbered and hand-signed by the artist FROOSTY®, and additionally features a FROOSTY® embossed stamp.

ADDITIONAL PRODUCTS. Selected FROOSTY® artworks, motifs and designs may also be offered as greeting cards, postcards, collector cards and other selected products. Depending on the respective product or series, these may be offered as Open Editions, Limited Editions or limited releases. The applicable edition type, quantity, numbering and any additional product-specific characteristics are stated on the respective product page.

AUTHENTICITY. Certificates of Authenticity are supplied only with those FROOSTY® categories and products for which a certificate is expressly specified. In particular, AI ARTWORKS and AI COLLECTOR’S EDITIONS include a Certificate of Authenticity. AI POSTERS do not include a Certificate of Authenticity.

MATERIALS & PRODUCTION. FROOSTY® Fine Art Prints are produced using the printing methods, papers and materials stated for the respective product. Where expressly specified on the product page, this may include pigment-based printing on Hahnemühle papers such as Photo Rag® 308 g/m² or Photo Rag Satin® 310 g/m². Materials and production methods for cards, merchandise and other products may differ and are stated on the respective product page. No particular paper, material, printing method, durability or other characteristic applies unless it is expressly stated for the respective product.

2) OWNERSHIP, COPYRIGHT & USAGE RIGHTS

2.1 OWNERSHIP OF THE PHYSICAL ITEM. By purchasing a physical FROOSTY® artwork, print, edition, design or other product through froosty.ai, the purchaser acquires ownership of the purchased physical item subject to full payment of the purchase price and the retention of title agreed in the applicable Terms of Service & Conditions.

The purchase of a physical item does not by itself transfer copyright, reproduction rights, commercial exploitation rights, publication rights, licensing rights, trademark rights or other intellectual property or usage rights in the underlying artwork, motif, design, photograph, text or other protected content. Rights of use are transferred only where and to the extent expressly agreed or otherwise provided by applicable law.

In particular, the purchase does not grant a licence to commercially reproduce, manufacture, publish, distribute, license, digitally exploit, make available online, use for advertising, merchandising, print-on-demand, NFTs or blockchain-based exploitation, or incorporate the artwork, motif or design into other products or commercial content unless expressly authorised by the respective rights holder or permitted by applicable law.

Statutory limitations, exceptions and other legally permitted uses remain unaffected.

RESALE OF THE PHYSICAL ITEM. Any lawful resale or other further distribution of an acquired physical artwork, edition or product is governed by the applicable statutory provisions. Where the statutory principle of exhaustion applies, the lawful resale of the physical item is not prohibited. Such resale does not transfer any additional copyright, reproduction, licensing, publication, trademark or other intellectual property or usage rights in the underlying artwork, motif or design.

The contractual terms applicable to an order are those made available to the customer and validly incorporated into the respective contract during the ordering process. The current Terms of Service & Conditions can be accessed online.

2.2 RIGHTS RESERVED BY FROOSTY®. Insofar as copyright, design, trademark or other intellectual property rights exist, those rights remain with Christian Kernchen or the respective rights holder. Unless otherwise stated, rights in protectable human-created contributions by Christian Kernchen, including artistic conception, photographic elements, individual selection and arrangement, digital compositing, image editing, texts, graphics, layouts and branding, remain with Christian Kernchen.

The sale of a particular artwork, print or edition does not prevent Christian Kernchen | FROOSTY® from using the underlying artwork, motif, composition or design in other legally permissible ways unless the respective product description or an individual written agreement expressly grants broader exclusivity.

The designation Limited Edition relates to the specific physical version, format, material, dimensions, configuration, edition size and product characteristics stated for that edition. FROOSTY® will not produce or market more items as part of that specifically described edition than the stated edition size.

The designation unique work or unique edition relates to the single physical work in the specific version, format, material, dimensions, configuration and product characteristics stated for that work. Unless broader motif exclusivity is expressly promised, it does not transfer exclusive rights in the underlying motif or design.

Unless the respective product description or an individual written agreement provides otherwise, the limitation of a specific edition does not prevent clearly distinguishable versions, formats, sizes, materials, presentations, details, crops, colour variations, black-and-white versions or other artistic adaptations from being created or used outside that specific edition. Such versions must not be presented as additional copies belonging to the specifically defined Limited Edition or unique work.

FROOSTY® may also use selected artworks, motifs and designs for other product categories such as postcards, greeting cards, collector cards, stickers, prints, apparel, accessories, interior products, merchandise and other design or lifestyle products, provided that no product-specific or individually agreed restriction applies and the presentation is not misleading as to the scope of a Limited Edition or unique work.

FROOSTY® may use its own artworks, motifs, photographs, designs and other content for presentation, documentation, portfolio, exhibition, marketing, editorial and promotional purposes, including use on froosty.ai, social media, newsletters, catalogues, books, magazines, press materials and other analogue or digital media, subject to applicable law and any rights of third parties.

All statutory rights of purchasers and other legally permitted uses remain unaffected.
