I. COPYRIGHT & CREATIVE PROCESS

Copyright protection exists only to the extent that the applicable statutory requirements are fulfilled.
CREATIVE PROCESS. Selected FROOSTY® artworks are created through a multi-stage, individually controlled artistic process. Depending on the respective work, this process may include conceptual development, visual research, composition, photography, AI-assisted image generation, individually developed prompts, selection and evaluation of generated material, digital compositing, image editing, colour grading, lighting adjustments, retouching and detailed manual finalisation.
Generative AI systems are used as technical and creative tools within this process. The final visual form of a work is developed through individual artistic decisions concerning the selection, arrangement, combination, modification and refinement of the respective visual elements.
Digital post-production and compositing may include the use of professional image-editing software. Individual visual elements may be selected, combined, modified, reconstructed, retouched or otherwise artistically processed. Colour, contrast, lighting, tonal values, composition and details may also be individually adjusted to create the final appearance of the work.
Under German copyright law, copyright protection requires a personal intellectual creation. Whether and to what extent an AI-assisted work or an individual element of such a work is protected therefore depends on the specific human creative contributions and the circumstances of the individual case.
RIGHTS. The purchase of a physical FROOSTY® artwork, print, edition or product transfers ownership of the respective physical item. Unless expressly agreed otherwise, it does not transfer copyright, reproduction rights, commercial exploitation rights or other rights of use in the underlying artwork, motif, photograph, design or other protected content.
To the extent that FROOSTY® content is protected by copyright or other intellectual property rights, it may not be reproduced, distributed, made publicly available, adapted, licensed or otherwise commercially exploited without prior authorisation unless the respective use is permitted by applicable law.
Statutory limitations, exceptions and other legally permitted uses remain unaffected. Infringements of existing copyright or other intellectual property rights may give rise to the claims and other legal consequences provided for by applicable law.
II. TRADEMARK LAW
FROOSTY® is a registered trademark. The scope of trademark protection is determined by the respective registration and the applicable trademark law.
The unauthorised use of the FROOSTY® trademark or an identical or confusingly similar sign in the course of trade may constitute a trademark infringement where the applicable statutory requirements are fulfilled. This may apply in particular to use on goods, packaging, labels, advertising materials, websites, social media, business documents or other commercial communications.
Nothing published on froosty.ai grants any licence or other permission to use the FROOSTY® trademark commercially unless such permission has been expressly granted.
Descriptive, referential and other uses permitted by applicable law remain unaffected. Unauthorised trademark use may give rise to the claims and other legal consequences provided for by applicable law.
III. AI TRANSPARENCY & THIRD-PARTY RIGHTS
Generative AI systems are used as technical and creative tools in the production of selected FROOSTY® artworks. Depending on the respective work, visual material may be generated or manipulated using AI systems and subsequently selected, combined, modified, composited, retouched and manually refined as part of the artistic process.
Where applicable, the use of AI-generated or AI-manipulated visual content is disclosed on the relevant artwork or product page in an appropriate manner. Such disclosure serves transparency and is independent of the assessment of whether and to what extent the respective work or its individual elements are protected by copyright.
If a rights holder believes that specific content published on froosty.ai infringes their copyright, trademark rights, personality rights or other legally protected rights, they may contact us at contact@froosty.ai.
The notification should identify the relevant content and its exact location, describe the right concerned and provide sufficiently specific information to enable the matter to be examined. Persons acting on behalf of a rights holder should also indicate the basis of their authorisation.
This contact option does not limit or exclude any statutory rights, remedies, claims or procedural options available under applicable law.
